INTRODUCTION

The Malaysian Biofuel Industry Act 2007 (Act 666) was enacted with the purpose of providing legislation for the mandatory use of biofuel, licensing of activities relating to biofuel and for matters connected therewith and incidental thereto. The Act was enforced on 1 August 2008, while the licensing activities under the Act as stipulated under the Malaysian Biofuel Industry (Licensing) Regulations 2008 was enforced on 1 November 2008.

2. According to Section 5, Malaysian Biofuel Industry Act 2007 (Act 666), activities that need to be licensed are as follows:

Under Section 5(3), Malaysian Biofuel Industry Act 2007 (Act 666), anybody who conduct the activities relating to biofuel without a valid licence, shall, on conviction, be liable to a fine not exceeding two hundred and fifty thousand ringgit or to imprisonment for a term not exceeding three years or to both.

CONDITIONS TO BE FULFILLED

4. In principle, the Government has agreed to consider applications for biofuel licence on a limited basis until 31 December 2009, subject to the fulfilment of the following conditions:

5. For the existing biofuel manufacturing licence holders, all applications shall be treated as a fresh application and not as an application for renewal of a licence. This is in accordance with Section 56(1), Malaysian Biofuel Industry Act 2007 (Act 666). According to the Section also, applications must be made within six months from the date of the coming into operation of this Act. Hence, the closing date for the application of the existing biofuel manufacturing licence holders is 30 April 2009.

6. With regard to companies that had applied for the biofuel manufacturing licence which had been frozen since 29 June 2006, they need to reapply for the licence on activities related to biofuel as stipulated under Section 5 Malaysian Biofuel Industry Act 2007 (Act 666).
